 No. Your sponsor cannot cancel your visa but they can terminate your employment. If you do stop working for your

current sponsor, you have 28 days to find a new sponsor and apply for a new 457 visa. You must phone DIAC on

131 881 or approach a DIAC business centre for advice within this 28 day period to ensure your visa remains valid.

You may also have the option of applying for another visa subclass. If you do not apply for another visa, you must

leave Australia before the end of the 28 days, unless you have received approval from DIAC for an extension.

If your employment has been terminated by your sponsor, DIAC must be notified. Your sponsor may be required to

continue paying you for a period of 28 days.

고용주는 457비자를 이미 받은종업원을 해고시킬수있으나 비자를취소시킬순없으며

종업원인본인이 자발적으로사표를 내고해당회사를 퇴사할수 있는권리가 있다.

고용주가 해고할수도있지만 본인이해당회사가 마음에들지않으면 퇴사할수있기에

이부분에서는 고용주와종업원이 동등한법적권리가 있다고 할수있다.

해당 회사을 퇴사했을 때에도 457비자는취소되지않는다.

참고로종업원이28일내에 새로운고용주를찾으라고 기간이명기되어 있으나 만약그기간안에 새로운고용주를 찾지못하면 변호사및법무사를 통해 기간을추가로 요구하여연장신청을 할수있으며 최고 60일까지기간을 연장하여 새로운회사를찾 을수있다.
